This complaint has been filed by Shri S.K. Verma (complainant) against
the PIO, Shri Warendra Sinha, Chief Regional Manager, Ghaziabad for delayed
transmission of information in response to complainant’s RTI-application dated
18.02.2008. The brief chronology is as follows:-

2. It is seen that there has been a delay of 23 days by PIO, Shri Warendra
Sinha, Chief Regional Manager, Ghaziabad in furnishing his reply.

3. PIO has explained that this delay was not wanton, or mala-fide but was on
account of the fact that the PIO had to obtain instructions from the public
authority’s Head Office regarding transmitting information as requested by the
complainant. This was what caused the delay. It is the PIO’s submission that
this was the first time that he was handling an RTI-application and despite his
best efforts, he could not prevent the delay as the correspondence with the head
office took longer than expected.

4. Considering all submissions in this matter, I’m inclined to agree with the
PIO that the delay in this matter was not on account of any negligence, or due to
deliberate withholding of information. It was mostly on account of the delay in
the completion of process of transmitting to the complainant authentic and
authorized information. In view of this, I do not wish to impose any penalty on
the PIO.
