The Board of Revenue has refused to interfere against the order passed by the
Sub Divisional Magistrate dated 06th October, 2006, passed in proceedings
under Section 41 of the Land Revenue Act, on the ground that from the report
of revenue authority it was apparent that the area of the chak of the applicant
was less viz-a-viz the revenue record, while that of the revisionist was more
and therefore Medbandi has been directed for demarcation of the plot as per
the revenue records.
I am of the opinion that no interference is warranted against the order of the
Board of Revenue dismissing the revision.
Writ petition is disposed of with liberty to the petitioner to initiate suit
proceedings for declaration of his title and possession.
