Facts
:
1. Both the parties were heard on 29/8/2008.
2. The appellant has grievances relating to service matters. In this context,
he has asked for certain information, which has been furnished. The appellant
has also been allowed inspection of the relevant records.
3. During the hearing, the appellant stated that in a specific note sheet it is
mentioned that Staff Associations submitted copies of their representations,
which were, however, not available in the relevant file nor there was any
reference in the note sheet. The appellant has, therefore, asked for copies of the
submissions made by the Staff Associations.
4. The CPIO stated that the desired information is not available. Hence, it
could not be furnished. He also made an attempt to access the document from
the custodian of the information, but could not be obtained because it being
about 5 years old was not available in the records.
Decision:
5. As the information asked for is not available, it cannot be furnished.
Moreover, the information asked for relate to the submissions made by the Staff
Associations, which are not public authorities. Therefore, such documents
cannot be accessed under the provisions of the Act, unless there is sound
justification on the ground of public interest or activity.
