Learned counsel for petitioner brought to our notice a typographical
mistake in the order passed on 24.05.2010. The said order reads as: “On
request of learned counsel for petitioner, let this matter be listed on
27.05.2010 as fresh.” Learned counsel for petitioner submits that the
adjournment mentioned in the order was granted not on his request but
on a request made by learned counsel for the State. This matter was
listed first on 12.05.2010, then on 24.05.2010, and thereafter on
27.05.2010. Learned counsel submits that the petitioner retired way
back in 2006 but since his Service Book for eight years’ of service on
deputation with Mandi Parishad was not sent to the Pension
Department, he is being put to a financial loss of Rs.4,500/- per month
which is being deducted from his normal pension since 2009.
On the other hand, learned counsel for State submitted that as per the
instructions received from the office of Senior Treasurer, Kheri, the
pension of petitioner has been determined on the basis of Service Book
completed by the Directorate of Agriculture. It is also brought to our
notice that the petitioner is in dire need of money, as he has suffered a
bypass surgery.

In view of all the aforesaid, we take a serious note of the conduct of the
Directorate of Agriculture. Thus, we direct the deduction of Rs.4,500/-
per month since December, 2009 from the salary of the Director,
Agriculture, U.P. and the same shall be deposited within a week with
the Registrar of this Court till the Service Book of petitioner is
completed.

Let this order be communicated by the Registrar of this Court to the
Chief Secretary, Government of U.P., for immediate compliance.
