Heard learned counsel for the applicant, the learned
Additional Government Advocate and perused the F.I.R.
and other relevant papers on record.
Submission of learned counsel for the applicant is that,
as alleged, the accused-applicant along with one co-
accused Shiva Kant was apprehended by S.O.G. police
personnel and 4 commercial and 45 domestic gas
cylinders were recovered from Mahindra pick-up which
they were transporting for selling to customers and also
for refilling purpose. Learned counsel for the applicant
submits that the accused-applicant has falsely been
implicated by police personnel and the recovery shown
is false and fake. He further contends that the applicant
is a mechanic and has a shop of repairing L.P.G. gas
burners. There is no evidence on record to show that
the accused-applicant was refilling gas cylinders. The
applicant is in jail since 20.11.2009, as averred in para
2 of the application and has no criminal history, as
averred in para 12 of the application.
Considering the facts and circumstance of the case, let
the applicant be released on bail in case Crime No.2194
of 2009 u/s 3/7 Essential Commodities Act, P.S. Kotwali
Bhinga, District Shrawasti on his filing a personal bond
and two sureties each in the like amount to the
satisfaction of the court concerned.
