COMMON ORAL ORDER

Both
these petitions are filed challenging the same award and order dated
17.5.2011 passed by the learned Judge of Labour Court No.1, Bharuch
in Reference (LCB) No.367 of 1997. Special Civil Application No.7262
of 2011 is filed by the workman, whereas Special Civil Application
No.10055 of 2011 is filed by the Management.

2. The
learned Judge was pleased to partly allow the Reference and held the
retrenchment of the workman as illegal and was pleased to order
payment of Rs.1,50,000/- in lieu of reinstatement and backwages.

3. The
workman has challenged this award on the ground that the amount
awarded is less, whereas the Management has challenged this award on
the ground that though there was suppression of the material fact,
the learned Judge has not taken into consideration the same and has
allowed the award in the aforesaid terms.

4. Taking
into consideration the rival submissions, the Court finds that no
case is made out by either party to interfere with the award and
order dated 17.5.2011 passed by the learned Judge of Labour Court
No.1, Bharuch in Reference (LCB) No.367 of 1997.

5. In
the result, both these petitions fail and the same are dismissed.
