ORDER
1. The
learned advocate for the petitioners in Special Criminal Application
No.1061 of 2008 files additional affidavit. The same is taken on
record.
2. Mr.K.P.Raval,
learned Additional Public Prosecutor, files an affidavit of
Mr.R.B.Rana, Deputy Superintendent of Police, Sarkhej in Criminal
Revision Application No.252 of 2007.
3. The
learned Additional Public Prosecutor submitted that as set out in
para-5 of the affidavit, the inquiry will be conducted with regard to
the allegations made in an application forwarded to the office of the
District Superintendent of Police by fax on 29.03.2006 and the same
will be completed within a outer limit of 15 days.
The
affidavit also deals with circular dated 23.07.2003 issued by the
Director General of Police, Gandhinagar. The deponent has set out as
many as 7 steps which will be taken with regard any application
received by In-charge of any Police Station alleging an offence which
may have involvement with regard to land dispute so as to determine
as to whether the dispute is of civil nature or criminal nature.
4. The
learned Additional Public Prosecutor, on instructions of the
deponent, states that though it is set out in the affidavit that
normally, a period of 30 days will be taken to undertake the
aforesaid exercise, in the case, wherein an application is tendered
by the petitioners of Special Criminal Application No.1061 of 2008,
the police will act expeditiously and will be able to decide the same
within 4-5 days.
A
copy of this affidavit be also placed in Special Criminal Application
No.1061 of 2008.
5. The
matters are adjourned to 12.08.2008.
