The
counsel for the petitioners submits that two of the
petitioners/appellants being dead, their heirs were to be
substituted, but it is not feasible to substitute in the present
petition and, therefore, the petitioners be allowed to withdraw this
petition for condonation of delay and the proposed appeal with a
liberty file a fresh petition for condonation of delay and proposed
appeal with proper parties – substituted heirs. On such
request, the prayed is allowed.

The
Civil Application, the Letters Patent Appeal and the Civil
Application for stay stand disposed of.
