Background
1. The Applicant filed his request on 06.05.09 with the CPIO, Senior Divisional Material
Manager, North Easter Railway, Bareilly seeking information related to the Pay Scale
as decided based on the Sixth Pay Commission recommendations, his pay scale which
has been fixed and seeking copies of the pay scales of four employees junior to him.
The PIO replied on 18.06.09 while enclosing information furnished by the Senior
Divisional Personal Officer, Izzat Nagar. The Senior Divisional Personnel officer also
enclosed along with his letter dated 15.06.09, a copy of the Pay Scale sheet and also
provided information in respect of points 3 and 4. Not satisfied with the information
the Applicant filed his First Appeal on 27.06.09 stating that information has been
deliberately denied to him. The Appellate Authority replied on 17.07.09 informing the
Applicant that the information has already been provided to him and also stating that
against point 3 para 2 the Applicant has asked questions for which information cannot
be provided. Being aggrieved with the reply of the Appellate Authority, the Applicant
filed his Second appeal before the CIC on 07.08.09 stating that he has asked for Pay
Scale of employees and the same has not been provided to him and that information
regarding pay scale have been denied to him under Section 8(1) j of the RTI Act. He
requested the Commission for information against para 1 to 4.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard the matter for
January 13, 2010.
3. The Appellant was not present during the hearing.
4. Mr. Om Prakash, Sr. DMM, Mr. A.K. Kathpal, ADRM, Mr. Suresh Manther, Sr. DPO and
Mr. S S Solanki, SWI represented the Public Authority.
Decision
5. The Appellant stated that while he has got the information he still requires the
calculation formula by which Pay Scales of the four colleagues whose names he has
mentioned in the RTI request have been fixed. A copy of the salary calculation sheet
was then handed over to the Appellant in the presence of the Commissioner during the
hearing. . The Appellant was satisfied with the information and the appeal is
accordingly disposed off.
