Heard
learned advocate Mr.Hukum Singh for the petitioner. The learned
advocate submitted that the court below has committed error in
passing order dated 09.03.2010, whereby the court directed defendant
no.1-Electricity Company to provide electric connection as per
prevailing rules and provisions of the Company. He submitted that
what is objectionable in the order is that the electricity company is
directed to consider the objection made by defendant no.1 (sic.,
defendant no.2-the present petitioner). The learned advocate then
submitted that defendant no.1 in the suit, viz. electricity company
does not insist for compliance of Condition No.4.1.17 which is
prescribed under the Electricity Supply Code and related matters
and Notification No.11 of 2005.
2. It
is premature to contend before this Court that the electricity
company is not complying with certain conditions.
3. On
perusal of the order where the learned Judge has directed the
electricity company to provide electricity connection as per the
prevailing rules and provisions of the Company, nothing objectionable
is found. Not only that the learned Judge has also said that the
electricity supply is to be made only if the plaintiff is found
eligible for electric connection. In view of that the present
petition is found without any substance. The same is dismissed.
