JUDGMENT
The petitioner is presently working as Assistant Jailor
Grade II in Special Sub Jail, Kozhikode. His grievance is that
promotion was due to the post of Head Warder on 31.5.2004.
However, the same was granted to him only with effect from
25.6.2004. Earlier, for redressing the grievances in the said matter ,
he had approached this Court by filing W.P.(C)No.15747 of 2009. The
same was disposed of as per Ext.P4 judgment with a direction to the
second respondent, the Additional Director General of Police to
consider the representation submitted by the petitioner and to pass
fresh orders thereon. According to the petitioner, in purported
compliance of the directions in Ext.P4 judgment, the second
respondent has passed Ext.P5 order. As per Ext.P5, the petition filed
by the petitioner was rejected. The petitioner has taken up the matter
further before the first respondent by filing Ext.P6 appeal. Ext.P6
dated 19.2.2010 is now pending before the first respondent. It is
aggrieved by the delay in the matter of disposal of Ext.P6 that this writ
petition has been filed.
Evidently, the petitioner has already moved the first

respondent raising his grievances against Ext.P5 order passed by the
second respondent. The said appeal is pending before the first
respondent. In the said circumstances, this writ petition is disposed of
with a direction to the first respondent to consider and pass orders on
Ext.P6 expeditiously, at any rate, within a period of three months from
the date of receipt of a copy of this judgment.
