Matter came up for hearing on 20.09.2010 through
videoconference (VC). Appellant was present at NIC VC facility at
Korba, while the respondents ― represented by the CPIO, Shri S.K.Mitra
― were present at NIC VC facility at Bilaspur. Commission conducted
the hearing from its New Delhi office.
2. In his secondappeal petition dated 03.04.2010, appellant has
requested disclosure of information relating to Sl.No.1 in his RTI
application dated 27.08.2009, which was regarding punishment to an
employee of the respondentCompany ― South Eastern Coalfields
Limited (SECL), should it be established that the said employee was
guilty of dishonest conduct in the matter of Company property.
3. CPIO, through his communication dated 31.08.2009, informed
appellant that, in matters such as cited by him as above, the guilty officer
is proceeded against under the Company’s CDA Rules/certified standing
orders, which were already placed on their website for general
information.
4. It is not clear from the appellant’s secondappeal petition as to how
the replies furnished by the CPIO were in any way deficient.
5. During the hearing, CPIO stated that it should be open to the
appellant to come to his office to inspect the documents related to his
RTIquery. If the appellant wishes to accept the CPIO’s offer, he may

within two weeks of the receipt of this order, file before the CPIO a
request for inspection of records, which shall then be granted to him
within the following two weeks after indicating to him the place, time and
date for such inspection.
6. Appeal disposed of with these directions.
7. Copy of this direction be sent to the parties.
