Background
1. The Applicant filed an RTI application dt.6.12.09 with the PIO, DRM Office, Northern Railway,
Ferozepur requesting for the norms pertaining to the preservation of running reservation charts of 2 nd class
sleeper prevailing upto and inclusive of disputed date 21st April, 2004. as given in letter dt.18.10.01 of the Dy.
Chief Commercial Manager, HQ Office, Baroda. On not receiving any reply, he filed an appeal dt.6.1.10 with
the Appellate Authority reiterating his request for the information. On still not receiving any reply, he filed a
complaint dt.11.2.10 before CIC .
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for August 26,
2010.
3. Shri Gyanchand, PIO & Head Clerk, Shri Seva Singh, OS and Shri Manmohan Singh represented the
Public Authority.
4. The Complainant was not present during the hearing.
Decision
5. The Respondents submitted that the RTI application was received on 16.12.09 and reply was
provided on 24.12.09 stating that Complainant had already been informed vide letter dt.20.1.09 that
charts of train No.1078 Dn (S2) sleeper class dt.7/8 Jan 2004 cannot be provided as after one year
records of reservation charts are being destroyed as per rules. The photocopy of the rule too had
been provided to the Appellant . The Respondents further added that in response to the first appeal,
the Appellate Authority too had replied on 23.3.10 upholding the decision of the PIO. The
Respondent produced a copy of the rule before the Commission.
6. The Commission after hearing the submissions holds that information sought is not available as the
charts had been destroyed as per rules and holds that the complaint is not justified.
7. The case is accordingly closed at the Commission’s end.
