No.43 of 2008 which was dismissed for default on 29.10.2009

by this court due to non-appearance of learned counsel for the

petitioner when the case was called out for hearing in

admission matter.

Considering the averments made by learned counsel

for the petitioner as well as the statements made in the petition,

it appears that genuine reasons have been shown which

prevented learned counsel for the petitioner from appearing on

the said date. Accordingly, this petition is allowed and C.R.

No.43 of 2008 is restored to its original file and number.
