Facts

:

1. The appellant was heard on 3/9/2008.

2. The appellant has grievances regarding permanent absorption in service
by the respondent. In this context, he has asked for certain information, which
has been denied u/s 2(f) of the Act, on the ground that the information is not
clearly specified.

3. During the hearing, the appellant stated that he has been rendering his
services to the respondent in the capacity of Asstt. Wireman, since 1985. He
stated that a number of his colleagues have been absorbed in service while his
claim has been ignored by the respondent. He also stated that the Supreme
Court has directed the respondent to regularize the services of the temporary
staff. But the respondent has not taken appropriate action in this regard. A
contempt proceeding against the non-implementation of Supreme Court order is
under progress, he said. He also stated that a part of information asked for by
him has been denied on the ground that the relevant file is not traceable.

Decision:

4. The appellant has been providing his services to the respondent in a
temporary capacity for about 25 years. He has, therefore, every right to know as
to why he has not been absorbed so far, even though the Court has ordered for
regularization of services of the appellant along with other employees.

5. The CPIO is directed to provide reasons for non-regularisation of services
of the appellant, at the earliest. The appellant should also be provided access to

the relevant records so as to enable him to observe and scrutinize the action
taken by the concerned officials in regard to his various representations for his
permanent absorption in service.

6. The CPIO is directed to allow inspection of records within 15 working days
from the date of issue of this decision. The date and time for inspection of
records should be mutually decided by the parties.

7. The appeal is thus disposed of.
