Petitioner had purchased land measuring 5 kanals situated

within the municipal limits of Safidon. Sale deed was executed on

26.4.2005. In the sale deed, sale consideration reflected was

Rs.2,82,000/-. Sub Registrar made a reference to the Collector that land

has been undervalued.

The department projected the case that the land is not only

situated in the Municipal Limits of Safidon but falls on the passage of

southern side of colony which is existing in the vicinity. They further

found that there is a Modern School on Rampura Road and the land fall

in between the colony and the School. The Authorities determined the

land to be residential and came to conclusion that the rates prescribed

by the Collector for the residential land are to be applied. The concurrent

findings of two Courts below have been assailed in the present writ
Civil Writ Petition No. 16283 of 2009 2

petition.

Appreciation of facts and disputed questions cannot be

determined by this Court. There is no perversity in the findings returned

by the two Courts below. Hence, no interference by this Court is called

for. The impugned orders are upheld and the present writ petition is

dismissed.
