3 12.7.2011 Heard learned counsel for the petitioner and learned
counsel for the State.
According to petitioner she had highest marks when so
called merit list was prepared and therefore she is entitled for her
appointment on the post of Anganbari Sevika.
The stand of the respondents in the counter affidavit is
that the so called merit list was rough chart which was prepared based
on the applications filed and the matter was looked into. It was found
that father-in-law of the petitioner is a P.D.S. dealer and in terms of the
guidelines for Anganbari Sevika persons of such kind are debarred
from consideration. That is the reason why one Ruby Kumari was
found fit as per her percentage of marks and had been appointed as per
the guidelines annexed with annexure-A.
There is no denial or rebuttal of the stand taken by the
State by the petitioner. If that be so then obviously the petitioner is not
qualified to be appointed or has otherwise suffered any infirmity
because of the above stated facts.
In view of above no direction in her favour for
appointment can be made by this Court.
This writ application has no merit and it is dismissed.
