The interim order of the Commission is as follows:
“This matter was taken up for hearing on 21.1.2009 in response to Commission’s notice dated
7.1.2009. Appellant was absent when called. Respondents were present through Ms. Jeny John, AGM and
Ms. Jyoti Rathod, Manager, SEBI. Third-party (Bombay Stock Exchange) was present through its counsels.
2. During the hearing, it emerged that the respondents had to take a clear position regarding whether
they had the power to access the information held by the third-party under Section 2(f) of the RTI Act within
the provision of the SEBI Act which authorizes them to access this variety of information held by the third-
party.
3. Matter is accordingly adjourned to the next date of hearing for respondents to file their written
submission – which should be also transmitted by them to the third-party and the appellant – for the
consideration of the Commission.
4. Matter adjourned.”
