Background:
Shri Prem Chand of Ajmer filed an RTI-application with the Public
Information Officer, North Western Railway, Jaipur, on 16 August 2007, seeking
information/documents relating to the selection of Assistant Personnel Officer.
2. The PIO vide his letter dated 10 September 2007 replied to the RTI-
application. Not satisfied with the reply of the PIO, the Appellant filed an
appeal with the first Appellate Authority on 5 October 2007 who vide his letter
29 November 2007 replied to it. Thereafter, the Appellant approached the
Central Information Commission with a Second Appeal on 24 January 2008 which
was registered in the Commission on 7 May 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 19 September 2008.
4. Shri Rajeev Singh, PIO, Shri N.S. Chanda, SPO and Shri M.K. Sharma, APIO,
represented the Respondents.
5. The Appellant, Shri Prem Chand, was neither present nor send any
representative for the hearing.
Decision:
6. In the absence of the Appellant, the Commission heard the Respondents
who maintained that they had replied to all the queries of the Appellant except
for disclosing the answersheets of his own as well as of the other candidates
who appeared for the Group ‘B’ post of APO (LDCE 30 per cent) in 2007. The
Commission was somewhat surprised at this stand of the Respondents in not
disclosing the answersheets to the Appellant in view of the number of
decisions/orders on the subject passed earlier by the Commission. It now
directs them to open up all the answersheets of the candidates the Appellant
wants to see and provide him (if he desires) a copy of his own answersheet.
This may be done by 27 February 2009.
7. The case is thus disposed of.
