Heard learned counsel for the petitioners Sri Anurag Kumar Singh and Sri
K.S. Pawar for respondents 2 and 3.
Sri K.S. Pawar, appearing for respondents 2 and 3, says that the dates of
election have been notified as far back as on 30.6.2010 and 11.9.2010 has
been fixed for election of Committee of Management and 12.9.2010 has been
fixed for election of Chairman and Vice Chairman.
Under the circumstances, we direct that the elections may be held as per
schedule, but in the meantime, the Administrator shall not be appointed, if he
has not been appointed yet.
The petitioners are also directed to cooperate with the Registrar in the matter
of holding elections and complete the formalities, including deposit of
required fee etc. In case the petitioners do not cooperate in holding the
elections, it would be open to the Registrar to approach this Court and get this
order modified.
The writ petition is disposed of accordingly.
