Mr. Sameer Sharma, appearing on behalf of the appellants, very fairly states
that the issue involved in this appeal has been answered against the appellants
in Special Appeal No. 1237 of 2003 (Managing Director and Others v. Gopal
Ji Mishra and another and Special Appeal (Defective) No. 919 of 2004 (Uttar
Pradesh State Road Transport Corporation and another v. Devi Prasad) and
analogous appeals.

In view of aforesaid, the appeal stands dismissed.
