Heard learned counsel for the applicant and learned AGA and perused the
record.
Counsel for the applicant submitted that recovery was in joint possession.
Counsel for the applicant submitted that in fact the applicant has taken lift in
the truck. He was sitting as a passenger and there was no recovery of any
weapon or articles from the possession of the applicant. No one was named in
the F.I.R. However, recovery of truck was shown in joint possession of four
persons including the applicant. There is no criminal history. Bail application
of co-accused Manoj was allowed on 16/06/2009 and prayer for bail of the
applicant was rejected. The applicant is in jail since 19/10/2008.
Considering the period of detention and the fact that co-accused has already
released on bail, let the applicant, Satish be released on bail on his furnishing
personal bond and two sureties of the like amount to the satisfaction of the
Court concerned in Case Crime No. 621 of 2008, under Sections 379, 411,
420 I.P.C., Police Station- Budhana, District – Muzaffarnagar.
