Background
1. The RTI application was filed by the Applicant on 10.11.09 with the PIO, Northern Railway, Lucknow
requesting for information against 5 points including documents as also opinions of the PIO on
various issues. The PIO provided an interim reply on 10.12.09 informing the Applicant that the
application ha d been transferred to the Sr. Div. Personnel Officer, Northern Railway, Lucknow to
provide information against points 1, 2 & 3 and with regard to point 4 information is being collected
and would be sent soon. On not receiving any further information, the Applicant filed his first appeal
on 8.1.10, once again seeking information. The PIO replied on 12.2.10 requesting the Appellant to
inspect the files against points 14. Not satisfied with this reply, the Appellant approached the
Commission with a complaint on 1.4.10 requesting for the missing information against points 1 to 3.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for August 19,
2010.
3. Shri Prakash, PIO & Shri Neeraj Gupta, deemed PIO represented the Public Authority and were
heard through video conferencing.
4. The Applicant was present during the hearing.
Decision
5. During the hearing the Complainant sought information against points 1 to 3. However, the
Commission on perusal of the information sought against these points observed that the Complainant
is simply seeking the opinion of the PIO and not any information as defined in Section 2(f) of the RTI
Act. With regard to points 4 & 5 the Respondent submitted that the letter as sought by the
Complainant could not be located in the file. The Commission directs the PIO to confirm this
information about the non availability of the letter to the Complainant in writing by 20 th September,
2010.
6. The appeal is accordingly disposed of.
