ORAL
JUDGMENT
1 Respondent
No. 1 is a Part-time Lecturer in the subject of Sociology, serving
with L.D. Arts College, Ahmedabad, i.e. petitioner No.2 herein. At
the relevant point of time, the respondent No. 1 could not be
allotted any lecture during the Academic Year 2001-2002 due to
fall in the workload and, therefore, she had preferred an
Application No. 20 of 2001, before the Gujarat Affiliated Colleges
Tribunal. The Tribunal granted interim relief in favour of the
respondent No. 1, restraining the petitioners herein from
implementing the decision of reducing the lectures of the
respondent No.1 and consequent reduction in the rank. The
Tribunal, thereafter, vide order dated 12.7.2001 confirmed the
interim relief, which was granted earlier in favour of the
respondent No.1.
2 The
said order dated 12.7.2001 passed by the Tribunal confirming the
interim relief granted in favour of the respondent No. 1 is the
subject matter of challenge in the present petition.
3. Today,
Ms. K.J.Brahmbhatt, learned Counsel appearing for the petitioners,
makes a statement that, by virtue of interim relief which was
granted earlier and confirmed by the Tribunal, respondent No.1 has
continued to deliver lectures at L.D. Arts College, Ahmedabad, and
no cause of action now survives for the petitioners to pursue with
the petition.
4 In
light of what has been stated by the learned Counsel for the
petitioners, nothing further requires to be done in the petition and
the same is accordingly disposed of. Rule is discharged.

J.)
