ORDER

Rule.

Ms.Manisha L. Shah, learned Additional Public Prosecutor, waives
service of Rule on behalf of the State. Heard Mr.Pratik Barot,
learned advocate for the applicant and Ms.M.L. Shah, learned
Additional Public Prosecutor for the State.

Following
aspects are considered:-

(i) The
applicant is facing charges for the offences punishable under
Sections 379 and 114 of the Indian Penal Code, Sections 3 and 7 of
the Damage to Public Property Act and Sections 3 and 7 of the
Essential Commodities Act.

(ii) Allegation
against the applicant is that of travelling on a Motorcycle ahead of
the Car involved in the offence.

Considering
the above aspects, the application deserves to be allowed and the
same is allowed. The applicant is ordered to be released on bail in
connection with CR No. I 117 of 2010 lodged with Kadi Police
Station on his executing a bond of Rs.10,000/- (Rupees Ten Thousand
Only) with one surety of the like amount to the satisfaction of the
lower Court subject to such conditions which the lower Court may
deem fit to impose.

Rule
is made absolute.

Direct
service is permitted.
