02. 25.11.2010 Heard learned counsel for the

petitioners and learned Additional Public

Prosecutor for the State.

Supplementary affidavit has been

filed on behalf of the petitioners.

                               In     this    case     instituted      against

                 altogether     seven       persons,     petitioners       name

emerged during investigation, the persons also

involved in the episode and killing of son of

the informant. The persons through whom the

informant got information about brutal killing

of his son though have not named in the First

Information Report and subsequently during

investigation their statements under sections

161 and 164 of the Code of Criminal Procedure

appears recorded stating the alleged role

played by the petitioners, since investigation

is going on.

Considering the facts and circumstances

of the case, in the event of their

arrest/surrender before the court below within

four weeks of receipt of the copy of this

order, till submission of charge sheet,

petitioners, namely, Jhulo Singh and Mukesh

Kumar, are directed to be released on bail on

furnishing bail bond of Rs. 10,000/- (ten

thousand only) each with two sureties of the

like amount each to the satisfaction of Chief

Judicial Magistrate, Khagaria, in connection

with Beldaur P.S. Case No. 29/2010 (G.R. No.

607/2010), subject to condition laid down under

Section 438(2) of the Criminal Procedure Code

with additional condition to remain physically

present before the court below on each and

every date till submission of charge sheet, in

case of failure on two consecutive dates, the

liberty shall be deemed to be cancelled.
