The
application has been preferred for condonation of delay of 35 days in
preferring the appeal against the judgment and order dated 22nd
October 2010 passed by the learned Single Judge in Special Civil
Application No.4911 of 2000. It is stated that after order was
passed by this Court the matter was informed by the counsel after
delay on 21st
December 2010 as the applicant is residing in the interior village
which is 300 km away from Ahmedabad and he has no knowledge about the
order earlier.

Notices were
issued on the respondents. No affidavit is filed opposing the
prayer.

Taking into
consideration the stand taken by the petitioner and being satisfied
with the ground, the delay of 35 days in preferring the appeal is
condoned. Civil Application stands disposed of.
