Facts

:­ 

1. By   preferring   RTI   request   dated   13   March   2010 
before   the   CPIO,   the   New   India   Assurance   Company 
Limited, Mumbai, the applicant sought to have copy of 
receipt register of the office/secretariat of the CMD 
of   the   company   for   the   period   8   February   2008   –   15 
March 2008.

2. The   CPIO   vide   his   order   dated   25   March   2010 
denied disclosure of information by citing section 8 
(1)   (d)   of   the   Act.   The   applicant   preferred   appeal 
dated   21   April   2010   against   this   order   before   the 
first appellate authority who disposed of the matter 
vide order dated 29 April 2010 by concurring with the 
CPIO.

3. The appellant preferred second appeal before the 
Commission to challenge the above orders. The matter 
was   heard   today.   Respondent   was   present   in   person. 
Appellant   was   present   and   heard   through 
videoconferencing   from   Sangrur.   Respondent   stated 
that   information   pertaining   to   the   receipt   register 
of the office of the CMD could not be provided as the 
register  held  not only  the  names  of the senders  but 
also had a column in which the subject matter of the 
letter   was   listed.   Therefore   it   was   very   possible 
that matters pertaining to commercial interest of the 
company   which   would   normally   not   be   divulged   under 
the  provisions  of section  8 (1) (d)  would  be placed 
in the public domain   through this disclosure to the 
detriment   of   the   business   of   the   company.   Appellant 
stated   that   he   was   interested   to   have   information 
pertaining to the receipt of award pertaining to his 
own case in the office of the CMD.

Decision

4. After  hearing  both  sides  the Commission  directs 
respondent   to   provide   a   copy   of   the   register   after 
severeing   columns   4   and   5   on   each   page   as   per   the 
provisions of section 10 of the RTI Act in respect of 
all   entries   except   the   ones   pertaining   to   the 
appellant for the period mentioned above. Information 
to   be   provided   within   two   weeks   of   receipt   of   the 
order.
