This
matter was listed before this Court on 21.06.2011. On that day, the
matter was adjourned to 04.07.2011 on joint request of the learned
advocates for the respective parties.
On
04.07.2011, this Court has passed the following order.
“Mr.
P.V. Hathi, Learned advocate for the applicants, has filed a note,
seeking retirement from the matter. Mr. P.V. Hathi, learned
advocate, is allowed to retire from the matter.
The
matter is fixed for next hearing on 5th July,
2011.
Office
is directed not to show the name of Mr. Hathi, as learned Advocate
for the applicant.”
Through
oversight the matter could not be listed on 05.07.2011n and
therefore, it was listed on 12.07.2011. On 12.07.2011, this Court
has passed the following order:
“Applicant
No. 1 is present in the Court today and request for time to engage a
lawyer. As a last chance S.O. to 19.07.2011. It is made clear that I
on the next date alternative arrangement is not made, the matter
will be proceeded further. ”
Today,
when the matter is called out, the applicant No.1- party-in-person
remained present and he sought adjournment. Since the matter is of
the year 1999 and sufficient time is granted to the applicant to
engage the lawyer, this Court has no option but to dismiss the
matter. Hence, the matter stands dismissed.
