Petitioners had participated in Orchestra in the District level

Higher Secondary School Youth Festival. They were given the 3rd

prize. It is stated that the poor performance of the petitioners was

on account of the fact that there was intermittent power failure, as a

result of which, two instruments could not be played.

2. When this writ petition came up in the morning, in view of

the assertion made by the counsel for the petitioner, I had

adjourned the case to the afternoon with a direction to the

Government Pleader to get instructions.

3. The Government Pleader on instructions submits that,

according to the judges, there was no such power failure and no

such remark is noted in the tabulation sheet.

4. In view of this and in the absence of any material

suggesting to the contrary, I am not in a position to accept the plea

of the petitioner. Writ petition fails and is dismissed.
