Counsel   for   the   petitioner   submitted   that   suffice   it   will   be   for 
disposal of the present petition, if a liberty is reserved with the petitioner 
to prefer a fresh application for grant of mining lease, within a period of 
four   weeks   from   today   and   let   a   direction   be   given   to   the   concerned 
respondent authority to decide the same in accordance with law. 

2. Counsel   for   the   respondents­State   submitted   that   the   allegations 
levelled in the memo of the present petition that the petitioner had given 
an application for grant of mining lease is not true. In fact respondents­
State   has   not   received   any   application   from   the   petitioner   for   grant   of 
mining   lease.   Nonetheless,   if   any   fresh   application   is   preferred   by   the 
petitioner for grant of mining lease, the same shall be considered by the 
concerned   respondent   State   authority   in   accordance   with   law   and   the 
policy of the State. 

3. In   view   of   this   limited   submissions,   liberty   is   reserved   with   the 
petitioner   to   move   a   fresh   application   for   grant   of   mining   lease.   The 
application will be preferred within a period of four weeks from today by 
the   petitioner   and   I   hereby,   direct   respondent   no.   2   to   decide   the 
application preferred by the petitioner for grant of mining lease, if it is 
preferred   within   four   weeks   from   today.   The   decision   will   be   taken   by 
respondent   no.   2   in   accordance   with   law,   rules,   regulations   and 
government policies, applicable to the petitioner, within further period of 
six weeks upon receipt of the grant of mining lease application from the 
petitioner in due format with necessary requisite fees etc. 

4. This   writ   application   is   disposed   of,   in   view   of   the   aforesaid 
directions.
