2 21-09-2011 Heard Counsel for the petitioner and the A.P.P.

representing the State.

The petitioner is an accused in a case under Section

20 (B), 21, 22 and 25 of the Narcotics Drugs and Psychotropic

Substances Act.

The recovery of Ganja was made from the house of

Kishundeo Rai. As far as this petitioner is concerned, it is said

that he was seen fleeing away from the place of occurrence.

Learned Counsel for the petitioner submits that

there is no allegation of recovery of ganja and as such, there is

insufficient material to put him under the Narcotics Drugs and

Psychotropic Substances Act.

Be that as it may, the above named petitioner is

directed to be released on bail in Bidupur Police Station Case

No. 58 of 2010 on furnishing bail bonds of Rs. 10,000/- (ten

thousand) with two sureties of the like amount each to the

satisfaction of the 1st Additional Sessions Judge, Vaishali at

Hajipur.
