: The petitioners are accused in the case registered under
Section 414 of the Indian Penal Code.
Learned counsel for the petitioners submitted
that the petitioners have been falsely implicated in the case;
nothing incriminating has been recovered from their possession;
there is no report of theft of the coal; the petitioners are local
permanent residents; there is no chance of their absconding;
Learned A.P.P. opposed the petitioners’ prayer
for bail, but has not disputed the said contentions of learned
counsel for the petitioners.
Regard being had to the facts and
circumstances of the case, the petitioners, abovenamed, are
directed to be released on bail on furnishing bail bond of
Rs.10,000/ (rupees ten thousand), each, with two sureties of the
like amount, each, to the satisfaction of learned Chief Judicial
Magistrate, Dhanbad in connection with Jogta (Loyabad) P.S.
Case no.4 of 2011, corresponding to G.R. no.90 of 2011.
