This Criminal Misc. Bail Application has been filed with a prayer to release
the applicant on bail in Case Crime No.436 of 2006 under Section 376 I.P.C.
PS. Acchnera, District Agra.

Heard learned AGA and perused the record.
According to the prosecution case the applicant committed rape
with minor Km.Nisha who was aged about 3-4 years. After
hearing cry the witnesses reached and found Nisha in naked
condition and the applicant. He was caught by the villagers and
was brought to the police Chowki. However, subsequently during
trial the witnesses have become hostile.
In view of the above at this stage it is not a fit case for bail.no
interference is required and it is accordingly rejected.
However, if trial has not been concluded as yet, then the trial
court is expected to conclude the trial as expeditiously as without
unreasonable delay and unnecessary adjournment.
