2 08.03.2011 The petitioner is in custody in relation to Rohtas (Dehari)

Police Station Case No 11 of 2009 for offence under Sections 420, 323

and others sections of Indian Penal Code read with Scheduled Castes and

Scheduled Tribes (Prevention of Atrocities) Act. Originally, the

complaint was filed by the complainant which was later converted into the

present police case, inter alia, alleging that her husband had worked for

the petitioner in the year, 2003 for which there were certain dues.

Allegedly, petitioner had permitted them to occupy about 5 decimals of

his land with assurance that he will execute sale deed. That was not done.

The petitioner allegedly asked for further money which was also given but

the sale deed was not executed and when the petitioner insisted for the

same, she was abused and beaten. It is submitted that she had earlier filed

a case before the Labour Enforcement Officer for payment of wages in

respect of her husband. That case was found false. Only to pressurise,

this case was filed.

Be that as it may, the petitioner abovenamed is directed to

be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten

Thousand) with two sureties of the like amount each to the satisfaction of

Chief Judicial Magistrate, Kaimur at Bhabua in SC/ST Rohtas (Dehari)

Police Station Case No 11 of 2009.
