Heard
Mr.Shah, learned counsel representing the applicant and perused the
application. First Application No.3910 of 2010 came to be dismissed
for want of removal of office objection by order dated 23.12.2010 and
by means of filing this application, the applicant – original
appellant has prayed to recall said order and for restoration of the
appeal. Considering the facts and circumstances of the case and the
submissions made by Mr.Shah, learned counsel for the applicant –
appellant, the application is allowed in terms of paragraph 4(A).
First Appeal No.3910 of 2010 is ordered to be restored to the file of
this Court and one week’s time is granted to remove the office
objection in the appeal as requested on behalf of the applicant. MCA
stands disposed of.
