2 28.09.2010 Mr. Sharda Nand Mishra, learned counsel for the
petitioner very fairly submits that the matter relating to
appointment of the petitioner on the post of Panchayat Shikshak at
the first instance has to be gone into by the District Teachers
Appellate Authority and he would accordingly seek leave of this
Court to withdraw this application in order to move the said
authority.
That being so, this application is permitted to be
withdrawn by making it clear that if the petitioner would file a
complaint before the concerned Disstrict Teachers Appellate
authority the same shall be disposed of on merits without going
into the question of delay in filing such complaint, inasmuch as,
this writ application has remained pending before this Court from
22.2.2007.
With the aforementioned liberty this application is

permitted to be withdrawn.
