The
present application is filed seeking suspension of sentence during
the pendency of the appeal.
Learned
Advocate for the applicant states that taking into consideration the
fact that the convict is undergoing sentence imposed for an offence
under Sections 395, 397, 457 and 114 of the Indian Penal Code and
Section 135 of the Bombay Police Act, she has instructions to request
for the fixed date of hearing, so as to see that the applicant, who
is in jail for about 5 years by now, against sentence of 10 years, is
able to see fruits of his appeal, in the event it is allowed.
The
request is found reasonable.
While
declining the request of suspension of sentence, Registry is directed
to notify the Criminal Appeal for final hearing on 23.06.2011.
The
application is disposed of accordingly.
