Heard learned counsel for the applicants, learned A.G.A. and
perused the entire record of the case.
The submission of learned counsel for the applicants is that co-
accused Rukhsar and Achchu have already been granted bail by
this Hon’ble Court vide Criminal Misc.Case Nos. 6827(B) of 2009
and 7399(B) of 2009, respectively and the case of the present
applicant is similar to that of co-accused. Learned counsel for
the applicants claims parity, which is not disputed by the State
counsel. It is also submitted that the present case is triable by
Magistrate. The applicants are in jail since 5.12.2009 and there is
no criminal history of the applicants, as averred in paras 10 & 11
of the bail application, which is admitted by the State.
Considering the overall aspects of the matter, I hereby provide
that the applicants be released on bail in Case Crime
No.829/2009, under Sections 3/5/8 of Cow Slaughter and 11
Animal Cruelty Act and and 7 of Criminal Law Amendment Act,
P.S. Raunahi, District Faizabad, on their filing a personal bond
and two sureties each in the like amount to the satisfaction of the
court concerned/remand Magistrate.
