Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.
It is contended by the learned counsel for the applicant that co-
accused Ankur has been granted bail by this court and the case of
the applicant stands on same footing.
This factual aspect is not disputed by the learned A.G.A.
Co-accused has been granted bail by this court and the case of the
applicant stands on same footing.Applicant is not named in the
F.I.R and name of the applicant appeared during the course of
investigation.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant and
without expressing any opinion on the merits of the case, the
applicant is also entitled to be released on bail on the ground of
parity.
Let the applicant Shankar Yadav involved in Case Crime No. 262
of2009 , under Sections 302, 201 I.P.C. Police Station Eatmadpur
District Agra be released on bail on his furnishing a personal bond
with two sureties each in the like amount to the satisfaction of the
court concerned.
