1.0 Heard
learned advocate Mr. Vibhuti Nanavati for the appellant – Insurance
Company. Learned advocate for the appellant – Insurance Company
submitted that the Insurance Company is not liable to pay any claim
amount to the claimant of Motor Accident Claim Petition No. 894 of
2006, which is filed by the driver of Motorcycle bearing Registration
No. GJ-2-AH-2166, as he was not the owner driver. He submitted
that the Policy was only for the owner driver, meaning thereby,
if the owner himself was driving, then his personal accident risk was
covered up to a sum of Rs.1 lakh. He submitted that in the present
case, as the owner himself was not driving the vehicle, the claimant
of Motor Accident Claim Petition No. 894 of 2006 is not entitled to
be paid anything.
