This application has been filed for quashing the order dated 11th
January, 2010 issued by respondent no.2, whereby the petitioner
has been asked to show cause as to why manufacturer of brick kiln
of the petitioner may not be stopped.
Mr. Sunil Kumar, appears for the petitioner. Various submissions
have been made by the learned counsel for the petitioner for
assailing the issuance of show-cause notice.
Mr. Rajesh Mishra, appears for the respondents.
We are of the opinion that those submissions are not fit to be gone
into in the present writ petition.
Petitioner, if so advised, may file his show-cause and in case he
does so, needless to state that the authority shall consider the same
in accordance with law.
Writ Petition stands dismissed with the observation aforesaid.
