The learned counsel for the petitioner

submits that he could not produce certain

documents, which are relevant in the present

case, before the Sessions Judge, Churu,

therefore, he may be permitted to withdraw this

bail application with liberty to file fresh

bail application before the Sessions Judge,

Churu, who rejected his bail application under

Section 438 Cr.P.C. vide order dated 18th May,

2009.

The prayer is allowed. The bail

application is, accordingly, dismissed as

withdrawn, with liberty, as prayed for.
