Learned
advocate for the petitioner submitted that the petitioner is
knocking doors of the authorities time and again but without any
avail in respect of the grievances made in this petition. The detail
representation prepared by Advocate dated 04.03.2010 is also
submitted but unfortunately the efforts have not been made on the
part of the authority in correct direction. Therefore, the
petitioner would make composite detail representation in respect of
the grievances made in this petition to the Revenue Secretary,
District Collector and Mamlatdar of concerned taluka for appropriate
relief in respect of the grievances made in this petition and this
court may be pleased to direct the authorities to decide the same
and reply to the petitioner within stipulated time.
Learned
AGP on advance copy submitted that there cannot be any objection qua
such direction but three authorities have been proposed to receive
the representation, let there be sufficient time to them but instead
of all the three authorities, let there be a responsibility on any
one namely District Collector, respondent no. 2 herein.
In
light of the aforesaid submission, it is most appropriate that
following direction be issued :
The
petitioner would be at liberty to make composite representation to
the Revenue Secretary, District Collector and Mamlatdar of the
concerned taluka in respect of the grievances made in this petition
and if such representation is preferred within 10 days from today,
then, the respondent authorities may in consultation with each other
decide the same and appropriate reply of the representation with
reasons be supplied to the petitioner as early as possible
preferably within 60 days from the date of receipt of said
representation. In case, if the answer from the Collector of the
representation is against the petitioner, then, it would be open to
the petitioner to approach the Court challenging the same in
accordance with law.
In
view of this direction, Shri Shah, learned advocate appearing for
the petitioner seeks permission to withdraw this petition at this
stage. Permission as sought for is granted. Matter is disposed of as
withdrawn. No costs. Direct service permitted.
