ORDER

Rule.

Learned APP Mr. Pandya waives for opponent. With the consent of
learned advocates for the parties, the matter is taken up for hearing
today.

Heard
learned advocate Mr. Mehta for the applicant and learned APP Mr.
Pandya for the opponent State.

It
appears that learned Addl. Sessions and Fast Track Court Judge,
Gandhinagar, by order dated 30.08.2010 passed in Criminal Misc.
Application No.626 of 2010, imposed the condition “not to leave
Gujarat” while releasing the applicant on bail. The applicant
is the resident of Uttaranchal and is required to visit other states
for discharging his duties. It is stated that the applicant has
already surrendered his passport.

In
view of above, condition No.4, imposed by learned Addl. Sessions and
Fast Track Court Judge, Gandhinagar, by order dated 30.08.2010 passed
in Criminal Misc. Application No.626 of 2010, is modified to the
extent that the applicant shall not leave India in place of Gujarat
without prior permission of the trial Court.

Hence,
the revision application is allowed. Rule is made absolute.
