Petitioner who is working as a Technical Assistant has been removed from
service on the ground of misuse of official funds on the basis of an ex-parte
enquiry report.

The submission of the petitioner is that the petitioner was not associated with
the said enquiry and he has not been given any opportunity of hearing before
passing the impugned order which is by way of punishment.

Learned Standing counsel who has accepted notice on behalf of all the
respondents prays and is allowed a month’s time for filing counter affidavit.
Two weeks thereafter are allowed to the petitioner filing rejoinder affidavit.

Till the next date of listing the operation of the impugned order dated 20th
April 2010 shall remain stayed.
