An order dated 24.10.2009 passed by this Court was on wrong
statement given by Sri Praveen Kumar Mishra Advocate holding
brief of Sri Bharatji Agrawal Senior Advocate that second appeal
was already dismissed in default and it has been wrongly listed.

Office has listed this appeal today bringing to my notice that
second appeal was not dismissed in default but it was substitution
application which was dismissed in default on 28.7.2008.

I have perused the order passed on substitution application
no.2417 of 1979. Accordingly, order dated 24.10.2009 passed by
this Court is recalled.

Second appeal be listed on its turn.
