Result of the departmental test has been produced in Court in

a sealed cover by the counsel for respondent No. 3 and the same is taken

on record.

By this order I propose to dispose of CWP Nos. 2439 and

3305 of 2011.

Both the petitioners in these writ petitions did take the

departmental test but did not qualify the test but thereafter, one more test

was held by giving them another chance to clear the departmental

examination, in which they could not appear because of medical grounds.

As per the interim directions issued by this Court, the

petitioners in these writ petitions were allowed to take the departmental

test. In compliance with the order passed by this Court, the departmental

test has been held by the respondents and counsel for respondent No. 3

has produced a sealed cover containing the result of these two petitioners.

On opening the same, it transpires that Anupam Kaushal, who

is the petitioner in CWP No. 2439 of 2011, belongs to the General

Category has obtained 43 marks while the pass marks for this category

were 35. Renu Kumari, who is petitioner in CWP No. 3305 of 2011,

belongs to the B.C. Category and has obtained 51 marks and for this

category, the pass marks were 20. Both the petitioners, therefore, qualified

the departmental examination.

The result of the petitioners is taken on record and marked as

‘A’.

In view of the above and in the light of the fact that the

petitioners have passed the departmental test, they shall continue in

service as per the terms of contract.

Accordingly, both the writ petitions are allowed. The

termination orders of the petitioners dated 06.01.2011 (Annexure P-1) in

both these writ petitions are hereby set aside in the light of the petitioners

passing the departmental test.
