                           JUDGMENT

Petitioner calls in question Ext.P1. Ext.P1 is a general

transfer order. By the same, petitioner is transferred from Flying

Squad Range, Munnar to Periyar (East) Division Range.

According to petitioner, he is a member of the Scheduled Caste

Community and is entitled to priority and he is singled out.

There is a general allegation that the transfer made is to favour

interested employees of the Officers’ choice. Petitioner is

having serious heart disease and he relies on Exts.P2 and 3

Discharge Summaries in this regard. Heard the learned

Government Pleader also. Learned Government Pleader would

point out that there is a person who will be affected by the

granting of the relief to the petitioner, namely Shri Noble

Varghese, who is not made a party to this Writ Petition.

2. I do not find any reason to interfere under Article 226

of the Constitution with Ext.P1 which is a general transfer order.

Petitioner has already worked in the station for three years. But,

it is certainly open to the petitioner to represent his grievance

regarding violation of any guideline before the second

respondent. If the petitioner submits a representation before the

second respondent within two weeks from the date of receipt of

a copy of this Judgment, the second respondent will, after

affording an opportunity of being heard to the petitioner and

Shri Noble Varghese referred to at Sl.No.4 in Ext.P1, will take a

decision thereon in accordance with law, within a period of one

month from the date of filing the representation.

The Writ Petition is disposed of as above.
