FACTS
:
The matter is called for hearing today dated 1.6.2010. The parties have
not appeared before the Commission, despite notice. However, a fax message
has been received from Shri Sanjeev Jain, Joint CIT 24(2), Mumbai which is
extracted below :-
“This office is in receipt of notice of hearing dated 3.5.2010 in the case of
Shri M.H. Patel, Mumbai, issued u/s 19 of the Right to Information Act,
2005. As per this notice, appeal is fixed on 1.6.2010 citing reference No
ACIT-24(2)/RTI/3/2008-09 and Addl CIT, Rg 24 (2)/RTI/08-09.
On verification of the records available in this office, it is found that the
Hon’ble CIC has already passed an order vide File No
CIC/S/A/2009/000131 dated 11.2.2009 against the above reference
numbers ACIT-24(2)/RTI/3/2008-09 & Addl CIT Rg24(2)/RTI/08-09.
The copy of the order of the Hon’ble CIC is enclosed for ready reference.
This office has not received any order of the Hon’ble CIC or any other
authority calling back the order passed by the Hon’ble CIc on 11.2.2009.
In view of the above facts, it appears that the appeal in this case has
already been decided and there appears to be no requirement of fresh
hearing, even though, the Hon’ble CIc desires a fresh hearing, the same
may be intimate immediately so as to enable the undersigned to represent
for hearing on the given date.”
2. It, thus, appears to us that the matter has already been decided by the
Commission vide order dated 11.2.2009. Hence, the matter is ordered to be
closed.
